Kathmandu. A writ petition filed in the Supreme Court seeking a constitutional bench headed by Chief Justice Cholendra Shamsher Jabra is being heard on Thursday. The writ petition is being heard in a single sitting of Judge Hari Prasad Phuyal. Advocate Dr. Ganesh Regmi filed a writ petition on Wednesday stating that the Chief Justice has to sit in the Constitutional Court. The Chief Justice, who is also a member of the Constitutional Council, was told to stay on leave after the legal practitioners demanded not to look into issues related to the council.
However, the constitution gives the chief justice the right to sit in the constitutional court. The petitioner has demanded that the Chief Justice should sit on the constitutional bench.
Earlier, a meeting of the Constitutional Council chaired by Prime Minister KP Oli had recommended the appointment of 52 people to various constitutional bodies. A writ petition was filed in the Supreme Court against the recommendation of that appointment. Stating that the Chief Justice was also present at the meeting, the writ petitioners had demanded the Chief Justice Rana not to sit on the bench on the issue.
