Kathmandu. In the writ filed by CPN-UML Chairperson KP Sharma Oli against the Election Commission and the Speaker, the Supreme Court has ordered to withdraw the entire file. Supreme Court Justices Deepak Kumar Karki and A joint bench of Dr. Kumar Chudal has ordered to withdraw the original file of the decision taken by the Election Commission, Federal Parliament Secretariat, and Lumbini State Assembly.
The apex court has ordered the Election Commission to take a decision only after studying its original file on the basis on which the CPN (Unified Socialist Party) has taken a decision based on the party resignation law and the basis on which the Speaker of Lumbini State has taken a decision. The Election Commission had decided to register the CPN-U on September 25. Oli had filed a writ petition in the Supreme Court against the same decision.
UML chairperson Oli had filed a writ petition claiming that the party had registered the party by identifying the central member who had already taken action. Oli had demanded that Speaker Agni Prasad Sapkota reverse the Speaker’s decision saying that he had not recognized the 14 lawmakers taken by the party. The Supreme Court has also demanded the Speaker’s decision on September 29 not to recognize the UML’s parliamentary action. On that day, Speaker Sapkota had decided not to take action saying that a separate party had already been registered.
In the writ petition, Oli had demanded that the action taken by the UML against the two lawmakers in the Lumbini Provincial Assembly be rejected by Speaker Purna Bahadur Gharti. The Supreme Court has also demanded a copy of the decision of the Speaker of the Lumbini Provincial Assembly on September 19. After the split of the CPN-UML and registration of the Unified Socialist Party, Oli had filed a writ petition stating that the registered party was illegal.
The hearing began on Monday in a bench of Justices Karki and Chudal. The hearing was adjourned on Monday after the hearing was adjourned on Monday, but the bench sitting for the interim order discussion did not take any decision on the interim order. It has been ordered to submit the interim order for discussion again after the final decision is reached.
