Kathmandu. The Constitutional Bench of the Supreme Court has refused to give an interim order in the writ petition against the ordinance on political parties issued by the President on the recommendation of the Council of Ministers after the government led by Prime Minister Sher Bahadur Deuba ended the session of the House of Representatives.
A constitutional bench of Justices Deepak Kumar Karki, Mira Khadka, Harikrishna Karki, and Ishwar Prasad Khatiwada, including Chief Justice Cholendra Shamsher Jabra, has ordered that no interim order be issued. The government had brought an ordinance on political parties on August 20 so that any political party could split up to 20 percent members of the Central Committee or the parliamentary party. After the ordinance was issued, the UML split and the CPN-Unified Socialist and Janata Samajwadi Party split and the Democratic Socialist Party was registered.
Advocates Pravesh Subedi, Arjun Kumar Aryal, Dal Bahadur Dhami, and others had filed a writ petition at the apex court alleging that the party registration on the basis of the ordinance was wrong. A preliminary hearing was held in the Constitutional Court on Friday on the writ petition filed on September 26 and September 25. According to the writ petition, the bench refused to issue an interim order.
