Kathmandu. Former Home Minister Ram Bahadur Thapa Badal, who is the custodian and patron of the CPN-UML Chairman KP Sharma Oli-led semi-underground party Netra Bikram Chand’s Biplav-led CPN-UML Sarlahi in-charge Kumar Poudel, will be prosecuted.
After the Supreme Court ordered to re-investigate the ‘fake encounter’ of Kumar Poudel, who was killed in a police encounter on Ashar 5, 2076, action will be taken against the accused from the then Home Minister Thapa to Inspector General of Police Sarvendra Khanal and other police officers to constables.
A bench of Supreme Court Judges Anikumar Sinha and Hari Prasad Phuyal has ordered to register the complaint filed by Poudel’s mother Durga Debi. The police officer and constable involved in the incident and the doctor who played a role in covering up the incident will also be investigated.
Claiming that Kumar was killed in the complaint filed by the mother of the deceased Durga Debi, the then Home Minister Thapa and then Inspector General Sarvendra Khanal, then Chief District Officer of Sarlahi Krishna Bahadur Raut, Chief of District Police Office Sarlahi SP Gopal Bhattarai, then Chief of State Police No. 2 Hari Bahadur Pal has been demanded.
Similarly, Inspector Kiran Prasad Neupane of Area Police Office Lalbandi, SAI Suryakumar Karki, Dr. working at District Hospital Sarlahi. Birendra Kumar Mandal, Constables Satya Narayan Mishra, Binod Shah, Inspector Krishna Dev Prasad Sah, and Mayor of Bagmati Municipality Bharat Kumar Thapa have been ordered to investigate.
Mother Durga Debi had filed a writ petition in the Supreme Court on Ashoj, 12, 2078, after the police refused to make a complaint. Criminal charges against the then Home Minister Thapa and Inspector General Khanal, who lied to the parliamentary committee without implementing the investigation report of the National Human Rights Commission, will be investigated.
The National Human Rights Commission (NHRC) had found that a team close to Inspector General of Police Krishna Dev Prasad Sah, who was posted at the Special Bureau of Police from the Police Headquarters, had shot dead Kumar in Thin (Paital) below his ankle.
According to the commission’s post-mortem report, Kumar was hit by six rounds of bullets, one of which was fired from thin (Paitala) and came out of the upper side. The question of how the speech came out of Poitalamuni when the shot was fired in the encounter indicated that it was a fake encounter.
Govinda Sharma Poudel, a member of the commission investigating the Kumar Poudel encounter, said at the time that the commission had received details of Kumar being shot in the groin. Police had been claiming that others who were with him had fled and that Kumar had opened fire, prompting retaliation.
The commission’s preliminary investigation found evidence that Kumar was shot dead a few hours after he was taken, hostage.
The commission had recommended to the government two years ago to take departmental action against those who were directly involved in the case and ordered the police to take action against Poudel. But the government rejected the commission’s recommendation.
The commission had recommended the suspension of Inspector Krishna Dev Prasad Sah and constables Binod Sah and Satyanarayana Mishra involved in the shooting. The commission had made such a recommendation on 4, Kartik, 2076. After an on-site investigation and statements from concerned persons, the commission had concluded that Poudel was taken under control and killed by nine bullets.
The information given by Home Minister Thapa and Inspector General Khanal to the State Management Committee is false
The then Home Minister Ram Bahadur Thapa Badal had claimed in a meeting of the Parliamentary Committee on Public Administration on July 26, 2008, that Poudel was killed in an encounter with the police. He said the government had not instructed anyone to end the insurgency and would investigate Poudel’s death. In the meeting, Sarlahi MP Dr. Amaresh Kumar Singh and Mina Pandey had claimed that Poudel was killed in a confrontation without a double confrontation.
